Terms and Conditions

Preamble

The following Terms and Conditions govern the contractual relationship between Stargate Innovationhub, Florian Aboutara (hereinafter "Weddy" or "Provider") and the user (hereinafter "Customer") of the platform weddysuite.com.

Weddy provides the Customer with a platform for creating a personalized wedding homepage, including features such as guest management, RSVP, gallery, seating planning, and other planning tools.

§ 1 Scope

  1. These Terms apply to all contracts between Weddy and the Customer regarding the use of the platform weddysuite.com.
  2. The languages available for contract conclusion are German and English. In case of contradictions between language versions, the German version takes precedence.
  3. Deviating conditions of the Customer are not recognized unless Weddy expressly agrees to their validity in writing.

§ 2 Contract Conclusion

  1. The contract for the use of the free Free plan is concluded upon successful registration of a user account.
  2. Upon creating a wedding, the Customer automatically receives a free 14-day Standard trial. This enables time-limited access to Standard features, including website publishing, without providing payment information. The trial is granted once per wedding and starts from the creation date.
  3. Booking paid services (Basic, Standard, or Pro) is done by selecting the desired plan and completing the order process. The contract is concluded with the confirmation of the order by Weddy.
  4. The Customer must be at least 18 years old for registration.

§ 3 Service Description

  1. Weddy offers four plans:
    • Free (free): Basic features incl. wedding website (preview), guest list, RSVP, 20 photos, 4 design themes, budget planner (2 categories), task manager (5 tasks), gift registry (2 items), AI assistant (3 generations/month), and seating/room planner (preview mode without saving). The 14-day Standard trial allows temporary use of Standard plan features (see § 2 para. 2).
    • Basic: All Free features plus website publishing, 100 photos, 6 design themes, unlimited gift registry, and 1 team member
    • Standard: All Basic features plus unlimited photos, 14 design themes, unlimited budget planner and task manager, vendor management, analytics, and 3 team members
    • Pro: All Standard features plus all design themes, custom domain, seating/room planner (with saving), broadcast messages, AI assistant (500 generations/month), priority support, and unlimited team members
  2. Current prices and the detailed service description are available on the pricing page (weddysuite.com/pricing) and apply at the time of booking.
  3. Features with quantitative limits (e.g. budget categories, tasks, gift entries) remain usable on the Free plan. Existing data is not deleted on downgrade, but creating new entries beyond the respective limit is not possible.
  4. Weddy strives for platform availability of 99% on an annual average. Maintenance work will be announced in advance where possible.

§ 3a Free Standard Trial

  1. Each newly created wedding automatically receives a free 14-day Standard trial. During the trial, the Customer has access to Standard plan features, including the ability to publish the wedding website.
  2. The trial is free and does not require payment information. It does not constitute a paid contract and is not subject to the right of withdrawal under § 355 BGB.
  3. After the trial expires, the wedding is automatically downgraded to the Free plan. If the wedding website is published at that time, it is automatically taken offline (unpublished). The Customer is notified by email before the trial expires (3 days and 1 day before, and after expiry).
  4. All data created by the Customer (content, guest list, photos, settings) is fully preserved after the trial expires. An upgrade to a paid plan is possible at any time to restore full functionality.
  5. If a paid plan is booked during or after the trial and the website was previously published, it is automatically brought back online.

§ 4 Prices and Payment

  1. Current prices are available on the website. All prices are final prices. According to § 19 UStG, no VAT is charged.
  2. Paid plans are offered as a one-time payment (annual term). Payment is processed through Stripe. After the term expires, access to paid features ends automatically and the wedding is downgraded to the Free plan with its respective limitations, unless a new purchase is made. Previously created data is preserved.
  3. Payment is processed through the payment service provider Stripe. Available payment methods are displayed during the checkout process.
  4. In case of payment default, Weddy reserves the right to restrict access to paid features.

§ 5 Referral Program

  1. Weddy may offer a referral program through which existing customers can invite others to register on the platform (e.g., via a personal link or code).
  2. Attribution to the referring person requires that the invitation is made through the technical means provided by Weddy (e.g., using a referral link with attribution, entering a valid code at registration, or equivalent procedures as described by Weddy).
  3. If Weddy grants a discount for this purpose, it may be granted exclusively to the newly registered person ("referee") for the first invoice of a paid plan, if provided for and shown in the order or checkout process. A discount claim exists only with valid attribution and only insofar as Weddy offers the program at the respective time.
  4. Any discount is not payable in cash, cannot be combined with other promotions unless the checkout process indicates otherwise, and may be used only once per person subject to the conditions set by Weddy.
  5. Weddy is entitled to refuse benefits or correct attribution in cases of abuse, manipulation, or contradictory information.
  6. Weddy may adjust, suspend, or terminate the referral program, including the amount and conditions of any discounts. Weddy will inform customers of material changes in accordance with § 12 of these Terms.

§ 6 Duration and Termination

  1. The contract for the free Free plan runs indefinitely and can be terminated at any time by deleting the account.
  2. Paid plans (Basic, Standard, Pro) have a term of one year from the date of purchase.
  3. Termination of a paid plan is possible at any time and becomes effective at the end of the paid period. Within the first 14 days after contract conclusion, the contract can be withdrawn and the amount already paid will be fully refunded. After the 14-day period expires, no refund of amounts already paid will be made.
  4. Exception: When purchasing a custom domain through Weddy, withdrawal is excluded, as domain registrations take effect immediately and cannot be reversed. This is expressly confirmed during the ordering process.
  5. After the one-year term expires, paid access ends automatically. There is no automatic renewal or recurring charge. The Customer may purchase a new term via the platform. Weddy will notify the Customer by email in advance of the term expiration.
  6. The right to extraordinary termination for good cause remains unaffected.

§ 7 Customer Obligations

  1. The Customer is responsible for all content they post on their wedding homepage.
  2. The Customer undertakes not to post any illegal content, in particular content that:
    • violates applicable law
    • infringes third-party rights (e.g., copyrights, personal rights)
    • is harmful to minors, pornographic, or glorifies violence
    • is discriminatory or incites hatred
  3. The Customer is obliged to keep their access data secret and prevent unauthorized access by third parties.
  4. When using photos of third parties, the Customer must ensure that they have obtained the necessary consents.
  5. The Customer indemnifies Weddy against all third-party claims arising from violations of these obligations.

§ 8 Custom Domains (Pro)

  1. In the Pro plan, the Customer can use a custom domain for their wedding homepage.
  2. When registering a domain through Weddy, it is registered in the Customer's name. The Customer is the owner of the domain.
  3. The Customer is responsible for choosing the domain name and warrants not to infringe any third-party rights.
  4. Upon termination of the contract, the Customer can transfer the domain to another provider. Weddy supports the transfer upon request.

§ 9 Usage Rights

  1. The Customer grants Weddy the right to store, reproduce, and make publicly accessible the content posted by the Customer for the duration of the contractual relationship.
  2. The rights to the content created by the Customer remain with the Customer.
  3. Weddy grants the Customer a simple, non-transferable right to use the platform for the duration of the contractual relationship.

§ 10 Liability

  1. Weddy is liable without limitation for intent and gross negligence as well as for injury to life, body, or health.
  2. In case of slight negligence, Weddy is only liable for breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract in the first place. Liability is limited to foreseeable, contract-typical damage.
  3. Liability for data loss is limited to the typical recovery effort that would have occurred with regular and appropriate backup copies.
  4. Weddy assumes no liability for content posted by customers or their guests.

§ 11 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, which is available at weddysuite.com/privacy.

§ 12 Changes to Terms

  1. Weddy reserves the right to change these Terms, insofar as this is reasonable for the Customer. This applies in particular to changes in the legal situation, technical changes, or new features.
  2. The Customer will be informed of changes at least four weeks before they take effect by email. If the Customer does not object within this period, the amended Terms are deemed accepted.

§ 13 Final Provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  2. If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Wiesbaden.
  3. The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
  4. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
